Vicki Gunvalson Wants Judge to Dismiss Elder Abuse Suit

When it comes to the ongoing lawsuit against her, it seems as if Vicki Gunvalson She thinks she’s just “nailed to the cross like Jesus.”

A few months ago, a 74-year-old woman named Diane Field filed a lawsuit against the Real Housewives of Orange County alumna, her company, Coto Insurance and Financial Services, and Allianz Life Insurance.

Diane has accused Vicki and her business partner of financially abusing the elderly after she invested in an expensive insurance policy with them. However, Vicki denies any wrongdoing and has now asked a judge to dismiss the entire lawsuit.

According to Diane’s claims, she and her husband Gary had amassed a fortune of $6 million, mostly in stocks. Gary managed their investments, but when his health declined, she took over.

In 2019, Diane met with Vicki and her partner Ali for financial advice. Vicki agreed to help and began suggesting strategies to hopefully reduce taxes and increase future earnings.

Vicki initially suggested pensions, but Diane said she preferred stocks because she was more familiar with them.

Eventually, Vicki and Ali convinced Diane to invest in Allianz pensions, which led to complications. The lawsuit alleges that they used “fraudulent sales tactics” to pressure Diane into transferring the money into Allianz pensions, and persuaded her to buy a life insurance policy that she later discovered would cost her $300,000 a year. Gary’s health deteriorated further.

In Touch obtained Vicki’s motion to dismiss. In the motion, her attorney says she did nothing wrong and that Diane did not do “due diligence.” How amazing.

It said:[Diane] “They knew, or should have known in the exercise of ordinary care, of the risks and dangers involved in the mission in which they were engaged, but nevertheless, with full knowledge of these matters, they fully and voluntarily agreed to assume the risks and dangers involved in the mission.”

She also accuses Diane of being “negligent and derelict with respect to the matters alleged in” her lawsuit. Vicki and her attorneys want the entire case dismissed and Diane awarded $0.

The judge has yet to make a decision. Only time will tell if Vicki will eventually have to “scream” in the courtroom.
