Noella Bergner returns to court after ex-husband James Bergner’s trial

The Real Housewives of Orange County alum Noella Bergner Her ex-husband calls her “unreasonable.” James BergnerThe single housewife appears to be making it difficult for her ex-husband to see their son. He has asked the court to intervene on his behalf.

Noella and James began dating in 2015 and welcomed their son, James Michael Bergner Jr., via surrogate in 2019. They married in 2020 and moved to Puerto Rico.

But this is when things got complicated.

When James and Noella split in 2021, he filed for divorce in Puerto Rico, where they lived and owned a home. But Noella, who moved to Orange County to join the RHOC cast, filed for divorce separately in California. My first thought was that California’s community property laws played a role in her decision. But my friend Google told me that Puerto Rico also has community property laws. So who knows?

According to court documents obtained by In Touch, James, a well-known personal injury attorney, asked the court to dismiss Noella’s California divorce case. Noella, in turn, tried to dismiss the Puerto Rico case.

The Puerto Rico case was finalized in 2022. James and Noella reached an agreement that all property issues would be handled in the Puerto Rico case, while issues involving their son would be handled in California.

As part of her lawsuit in California, Noella asked for financial support, which she was entitled to as the mother of their son. At the time, she said, “I couldn’t afford the rent, and we had to move in with my boyfriend.” The ex-couple eventually agreed that James would pay her $25,000 a month in financial support.

California Case Puts a Hurdle in the Way of Nursery Business

For some reason, Noella did not dismiss her California divorce case even though the marriage ended in Puerto Rico. Unfortunately, the open case in California prevented the couple from resolving the outstanding issues of custody and child support time.

“Mr. Bergner cannot file a separate child custody case in California. He has tried… This court has denied his motion because the California divorce case has not yet been dismissed,” his attorney explained.

Since his efforts to reach any agreement with Noella have reached a “dead end, he needs the court’s intervention to ensure frequent, ongoing and reasonable contact” with his son. “Without the court’s intervention, Mr. Bergner fears that he and the child will continue to suffer from [Noella’s] “Unreasonable restrictions and orders regarding the period of raising children.”

Noila has not yet responded to James’s last suggestion.
